In 2012 the Flood and Water Management Act was passed. This created lead local flood authorities (LLFAs) across England and Wales. This placed new duties and powers within County and Unitary Councils.
Such responsibilities are:
• Determining ordinary watercourse consents;
• Investigating flooding instances;
• Development of flood risk management strategy;
• Maintain Asset Register;
• Becoming the SuDS Approval Body (SAB);
• Power to undertake works to manage flood risk from surface water, groundwater and ordinary watercourses; and
• Power to designate flood assets;
Later in 2015, the Secretary of State for Communities and Local Government laid a Written Ministerial Statement in the House of Commons making LLFAs a statutory consultee within the planning process. Schedule 4 Part (ze) of the Development Management Procedure Order requires a LLFA to be a statutory consultee for any ‘major development with surface water drainage’
